Application provisions of plant protection products for the protection of non-target terrestrial plants (NTTP) and non-target arthropods (NTA) on the treatment area (in-field)
Since December 2019, the German Federal Environmental Agency (UBA) has demanded that the application provision NT (new arable flora) for the protection of non-target plants (NTTP) and the application provision NT (new arable arthropods) for the protection of non-target arthropods (NTA) on the treatment area (in-field) should be fixed when authorising plant protection products. According to these provisions, the plant protection product concerned and other plant protection products which also have one of the application provisions may only be applied to a maximum of 90% of the treated area. Dr. Alexander Koof provides in the legal article StoffR 3/2020, # (german) a comprehensive legal assessment of whether there is a legal basis in Union or national law to make the granting of a plant protection authorisation dependent on the application provisions NT (new arable flora) and NT (new arable arthropods).
